Terms of Use

These Terms of Service ("Terms") govern your access to and use of the FitFive mobile application (the "App"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you must refrain from using the App. These Terms form a binding legal agreement between you and FitFive.

FitFive is a fitness tracking application that allows users to log workouts, track nutrition, and generate a personal Player Card based on five performance axes: Strength, Endurance, Volume, Consistency, and Nutrition. The App assigns an OVR score reflecting overall fitness level. FitFive is intended for informational and motivational purposes only and does not guarantee any specific health, fitness, or performance outcomes.

The App is intended for individuals who are at least thirteen (13) years of age. If you are under the age of eighteen (18), you represent and warrant that you have obtained the consent of a parent or legal guardian to use the App. Parents and legal guardians are responsible for the activities of minors using the App.

To access certain features of the App, you may be required to create an account. You agree to provide accurate and complete information when registering and to keep your login credentials confidential. You are solely responsible for all activity conducted through your account. Notify us immediately at support@fitfiveapp.com if you suspect unauthorised access to your account.

You may delete your account at any time through the account settings screen in the App. Upon deletion, your personal data will be removed from our systems in accordance with our Privacy Policy. FitFive reserves the right to suspend or terminate accounts that violate these Terms.

FitFive offers auto-renewing subscription plans (for example, monthly and annual Premium plans) that unlock additional features. The exact plan length, price, and any free trial period are displayed in the App before purchase and confirmed through the Apple App Store or Google Play payment interface.

By purchasing a subscription, you authorise Apple or Google (as applicable) to charge your chosen payment method for the plan you select. Subscriptions renew automatically for the same duration at the then-current price unless cancelled at least 24 hours before the end of the current billing period. Any unused portion of a free trial is forfeited once a paid subscription begins.

You can manage or cancel your subscription at any time through your Apple ID account settings (App Store) or your Google Play account settings. FitFive does not process payments directly and cannot issue refunds; refund requests must be submitted to Apple or Google in accordance with their respective policies.

We may from time to time offer promotional pricing or referral codes. Such offers are subject to the eligibility terms disclosed at the time of the offer and cannot be combined with other discounts or promotional offers.

You retain ownership of any content you submit, upload, or share through the App, including workout logs and nutrition data. By submitting content, you grant FitFive a non-exclusive, worldwide, royalty-free licence to store and process that content solely for the purpose of operating and improving the App.

You agree not to use the App for any unlawful or unauthorised purpose. You must not:

• Attempt to gain unauthorised access to the App, its servers, or its networks.
• Upload content that is abusive, defamatory, or infringes third-party rights.
• Reverse-engineer, decompile, or disassemble any part of the App.
• Impersonate another person or misrepresent your affiliation with any entity.
• Use the App in any manner that could disable, overburden, or impair it.

Violation of these rules may result in immediate suspension or termination of your account.

The App provides general fitness and nutrition information for educational and motivational purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider before beginning any exercise or nutrition programme, particularly if you have a pre-existing medical condition or injury. FitFive assumes no responsibility for any injury or adverse outcome resulting from use of the App.

All intellectual property rights in the App, including but not limited to the FitFive name, logo, Player Card system, OVR scoring algorithm, designs, and software, are the exclusive property of FitFive and its licensors. By using the App, you are granted a limited, non-exclusive, non-transferable licence to access and use the App for personal purposes only. You may not copy, modify, distribute, or otherwise exploit any part of the App or its content without prior written consent from FitFive.

The App is provided on an "as is" and "as available" basis. FitFive makes no representations or warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be error-free, uninterrupted, or secure.

To the fullest extent permitted by applicable law, FitFive shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the App.

We may suspend or terminate your account or access to the App at any time if you violate these Terms or if required by law. You may stop using the App at any time by deleting it from your device. Termination does not relieve you of any obligations incurred prior to such termination.

We may revise these Terms from time to time. If material changes are made, we will notify users by updating the effective date above and, where appropriate, by providing additional notice within the App. Continued use of the App following such changes constitutes acceptance of the revised Terms.

These Terms are governed by and construed in accordance with the laws of France. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts of France.
